Just received this in an email from BossKraft. I can only assume it is real......

Have you purchased Older car parts overseas ? Of Course you have !!

Well our trusty Green Empowered Labor Govt are at it again .... in TAX mode !!

Basically there are Tariff concessions in place for components/parts being imported for cars older than 30 years of age in Australia.

The government is now going to be dropping this concession and replacing it with the standard new auto parts tariff of 5-15% on top of the GST we pay on the parts when we buy them from our older parts retailers here already.

I am sure you can understand that even a 5% increase on these parts would put all of us at an even greater disadvantage then we already are as Enthusiasts and the retailers that sell or buy older auto parts.

FACT is that this will raise next to nothing in revenue for this Idiotic Govt who clearly wish to drive our older cars off the roads AND the small businesses we support daily to the wall ... by increasing our costs again & again.

I'm sure the likes of small business operators who imports old parts will be thrilled to bits to hear this news.

I think we need to seek clarification on this.
On 16 April 2012, I formed the belief in respect of the TCOs, that if the TCO was not in force on that day,
and an application for the TCO was made on that day, the CEO would not have made the TCO. That is because the
TCOs were made in contravention of s.269SD(1AA), in that the goods are incorrectly classified and fall to
multiple classifications.
Interested parties are invited to provide, by close of business Wednesday 16 May 2012, written reasons why
these TCOs should not be revoked. Interested parties may consider applying for new Tariff Concession Orders
on the application forms, B443 (updated March 2010) for the goods described below.

The TCOs that I intend to revoke fall to Tariff Classifications 8708.40.52,
8708.50.52, 8708.80.92, 8708.91.42, 8708.92.52 and 8708.94.52 and are
identically worded as follows:
PARTS, PASSENGER MOTOR VEHICLE, manufactured at least 30 years
before the goods are entered for home consumption, or reproductions
of these parts, being ANY of the following:
(a) suspension components being ANY of the following:
(i) top or bottom control arms;
(ii) uprights, struts and wheel hubs;
(iii) anti sway bars and ball joints;
(iv) anti tramp bars and torsion bars;
(v) suspension bushes, links, bump stops and shackles;

(b) brake and clutch bleeding nipples;
(c) hood retaining pins;

They are being revoked, but what's being revoked are the "Tariff Concession Orders" which says to me that the tariff will go up.
I wish my brain was working better tonight. I sent this, but it was not the best wordsmith effort.

To Whom It May Concern,

The document titled "Commonwealth of Australia Gazette No TC 12/16, Wednesday, 18 Apr 2012" came to my attention today, and as a classic car enthusiast, I'm interested to gain clarification on some of the content.
The area in particular is covered on pages 12 and 13:
"PARTS, PASSENGER MOTOR VEHICLE, manufactured at least 30 years
before the goods are entered for home consumption, or reproductions
of these parts"

If what I understand is true, and tariffs will be rising on these items;
- These parts are simply not made in this country, so the tariff is not protecting the local manufacturing industry. In fact, to the contrary, what this will do is hurt the local small businesses that cater for these classic vehicles.
- The cost of aquiring parts in Australia is already close enough to double the cost of aquiring in the USA for example, and all this will do is make the gap larger.

I run a popular classic vehicle website, and I can assure you that if these tariffs rise, this is going to be a huge concern for enthuiasts and the small businesses that support us.

Any clarification you can provide would be greatly appreciated.

OK, I don't think anything untoward is going on here. There are issues with the current TCO's and that is why they are being revoked. The importers simply need to apply for new TCO's that match the requirements.
Dear Mr Mills,

Thank you for your email.

The Tariff Concession Orders (TCOs) were listed for revocation as all of
them are legally invalid.

As you can see, all of the TCOs are identical in wording and cover a
number of different items.

However, each of the 6 TCOs are keyed to different Tariff
Classifications.

For example, TCO 0614555 is keyed to Tariff Classification 8708.92.52
which ONLY covers the following goods:

8708 PARTS AND ACCESSORIES OF THE MOTOR VEHICLES OF 8701 TO 8705:
8708.92 - - Silencers (mufflers) and exhaust pipes; parts thereof:

8708.92.52 .. - - - -Other, of a kind used as components in passenger
motor vehicles

So, despite all the parts listed in TC 0614555, only item (bb) exhaust
mounting brackets, plates, ribs and pipe straps may be eligible for
concessional entry as only these goods appear to meet BOTH the Tariff
Classification and the wording. Any other goods that have used this TCO
for goods other than mufflers and parts thereof have been incorrectly
entered (and technically owe duty). Unfortunately, the Illustrative and
Descriptive Material for those few goods that are described in the
wording AND fall to the correct Tariff Classification is inadequate (or
non-existent) to form a view as to the correct Tariff Classification.
Therefore, the only course of action is to notify an intention to revoke
all TCOs in their entirety.

This inconsistency arose as a result of a 'Tariff Harmonisation'
exercise in 2007 which occurs every five years to align Australian
Tariff Classifications with internationally used Tariff Classifications.
The anomaly was noticed during the current (2012) Tariff Harmonisation
exercise.

The purpose of the 'intention to revoke' rather than revoking outright
is to allow importers, such as yourself, to apply for new TCOs to cover
goods that you intend to import in the future. As soon as Tariff
Concessions receives an application that will be the operative date of
the TCO, if it were to be made. For TCOs that may be revoked as a
result of the intention to revoke notice, a 28-day in transit provision
exists, effective from 16 April 2012.

To assist you, I have attached a TCO application form and an Australian
Customs Notice that provides further information concerning TCO
applications.

Hi Guys,

I have done a fair bit of research into this as it would affect me and many others out there. Having read through the tariff classification documents and many tariff concession orders, and with speaking to the tariff office at Customs here is what I have come up with.

***Please note that this is my interpretation only***

Customs is going through a review of all their classifications and documentation (I think they mentioned that there are over 13 000 of them) and they are revoking anything that is incorrectly worded or that has multiple items on the one tariff concession order (TCO). This is the category that the above TCOs in the bulletin fall into. Apparently a TCO should not have more than one item written into it and it should be very generic.

As you will see above there are many different parts on the one TCO. Now this may seem all doom and gloom for importers of the above parts; however this is the one occasion where the seemingly slow moving organisation that is Customs works in our favour. With there being so many TCOs to review it may take a fair while for them all to be completed and there are still several instances of TCOs that are exactly the same as the ones above however they are not yet being revoked.

I never thought I would be thankful for government bureaucracy. However it is one to keep a close watch on in the future. I am sure that customs will eventually get to revoking all the currently incorrect TCOs, but how many more are going to need to be submitted in their place. If one new document for each item in the above list is applied for that is a heck of a lot of paperwork!

Don't forget that if the parts are made in the US from US materials they will still be covered under the US-AUS FTA also.
